A 10-meter geyser of crude oil spewed from a broken Kinder Morgan pipeline in a Burnaby neighbourhood in July 2007. Eight homes were flooded and 92 were put on evacuation notice. Part of the TransMountain Pipeline system, the broken pipeline was carrying crude oil from a pipeline terminal at the foot of Burnaby Mountain to a tanker-loading facility on Burrard Inlet. After four years in court, Kinder Morgan pled guilty. Justin Trudeau's new Kinder Morgan pipeline will ship 900,000 barrels of dilbit a day from Alberta through the same neighbourhood to the supertankers waiting in Burrard Inlet. National Energy Board presser in Calgary today, Robert Steedman :
"The NEB recommends that the Government of Canada find the Trans Mountain expansion project to be in Canada's public interest. ... The project would not likely cause significant environmental effects."
The Texas-based Kinder Morgan twinned pipeline will run from Alberta to Burnaby and Burrard Inlet BC, increasing tanker traffic by 600%. In January the National Energy Board sided with Kinder Morgan in refusing the Province of BC's request for more details on how KM would handle an oil spill, citing "commercial, security, and privacy reasons". Former BC Hydro CEO Marc Eliesen referred to the NEB as "industry-captured" and their Trans Mountain hearings as "a fraudulent process" and "a public farce" in his letter of resignation from the hearings. Not to worry, said the Federal Liberals on the campaign trail in BC in the October federal election :
“We are going to redo the National Energy Board process. We’re going to broaden the scope. We’re going to make sure it’s objective, fair and based on science.”
So what did we get? A three-person mini-NEB announced just two days before NEB gave the Trans Mountain its blessing - to listen to us alongside the same old NEB :
“The panel is not going to come back with a formal recommendation about whether the process should go ahead. It’s going to come back and tell the minister that this is what we heard from communities..."
"Justin Trudeau has told his senior lieutenants to draw up plans to make the Energy East pipeline and the Trans Mountain expansion in British Columbia a reality. The prime minister has been convinced by his finance minister, Bill Morneau, and other influential voices around the cabinet table that the pipelines have to be built to achieve the ambitious economic growth targets his government has set."
Never mind the Senate vagaries on where Duffy actually resides or whether other Senators porking out at the public trough is criminal or just Senate-business-as-usual. Forget all that. Of the various narratives emerging from the Duffy trial, the story that should be getting a lot more attention is that Con Party fundraiser Senator Mike Duffy appears to have served as a behind-the-scenes go-between between Enbridge and Stephen Harper while simultaneously connecting up environmental charities attack dog Vivian Krause, referred to by Ezra Levent as Sun TV's "forensic environmental detective", for an energy sector speaking tour. "Redacted entries in Mike Duffy’s diary suggest he was in regular undisclosed contact with pipeline giant Enbridge during the height of the federal government's scorching attacks on environmental activists and charities in 2012.
The suspended senator’s journal shows a flurry of conversations and emails with or about top-level Enbridge executives, then PMO chief of staff Nigel Wright and the Prime Minister between January and June of 2012, just as the National Energy Board started its hearings on the Enbridge Northern Gateway pipeline proposal."
CBC : "Duffy appears to be a fan of Krause's work, mentioning her at
least 10 times in his daily diary and setting her up with an agent for speaking
appearances." Setting her up with an agent? According to Krause, speaking fees for appearances before the resources industry now comprises over 90% of her income going back to 2012.
"The Prime Minister is threatening to prevent foreign environmental interests from delaying the approval of a pipeline that would take bitumen from the Alberta oil sands to the West Coast for shipment to Asian markets.
Kathryn Marshall, a spokesperson for EthicalOil.org. said Canadians have much at stake in the construction of the pipeline and “must take a stand against foreigners and their lobbying groups interfering in our decision.”
Cue Ethical Oil's Kathryn Marshall that same month with her "foreign special interests and their deep pocket puppets" :

In the 2012 budget, the Canada Revenue Agency launched a special $8M program aimed at punishing environmental political activity, later topped up to $13.4 million. On January 8, 2012, Duffy's diary notes an email and phone call exchange with Ethical Oil author and SunNews *personality* Ezra Levant "re: Vivian Krause". He then met with Krause on three occasions and had two telephone conversations. On February 9, 2012 Krause testified before the Standing Committee on Natural Resources about "deep-pocketed supporters south of the border" funding campaigns against the Canadian energy sector. Duffy was in attendance; his diary that day reads: "Lunch - Vivian Krause."

It's not like that's gone away. An RCMP report released this February raved on about “violent anti-petroleum extremists” and “violent aboriginal extremists,”driven by an “anti-petroleum ideology." Particularly concerning in light of the new Anti-terrorism Bill C-51 with its new engorged mandate to act against “activity that undermines the security of Canada”, the RCMP report suggests pipeline opposition movements should be seen and treated as national criminal security threats. It is 44 pages long. To back up its position, a full nine of those pages, or 20% of the entire report, are quotes from articles by Vivian Krause.

And finally, 12 hours after the leak was first spotted, someone remembered to let the City of Vancouver in on the secret.
So how could it possibly have taken so long to get their shit together?
Ok here's a clue. The Cons shut down the key responders in 2013.
We had a marine safety response purge when the Kitsilano Coast Guard base - 6 minutes away from the bunker fuel spill - was shut down to save $700K a year, and the special pollution response boat with its 300 meters of self-inflating oil- containment boom was moth-balled off to Richmond.
Volunteers were out cleaning up the gunk off the shoreline themselves and putting up home-made signs warning to keep dogs and children out of the oily water. Good on them. Still, sea birds are notoriously poor readers and some had to be rescued when they got soaked in the gunk after not obeying the signs.
CBC reports the leaking vessel was on its maiden voyage after being launched from a Japanese shipyard in February. So - a brand new vessel then.
According to Tanker Free BC, the proposed Kinder Morgan Trans Mountain pipeline and tanker project "would see an increase from the current 80 tankers a year to over 400 tankers a year carrying primarily tar sands bitumen which is more likely to sink in the marine environment potentially causing significant harm."
Too bad we don't have some kind of ocean traffic control tower to co-ordinate emergency response communications for the next one. ..... Wait for it .....
Fun fact : "Vancouver will also have to deal without a marine traffic communications centre (the ocean's equivalent to an air traffic control tower). The Conservatives shut that down last month, consolidating the Pacific Coast's operations to Victoria and Prince Rupert."
Fourteen years ago in Operation Kabriole, the RCMP blew up an oil installation in Alberta to establish the credibility of one of their undercover informants investigating tarsands sabotage. In a nice touch, Alberta Energy Company, now Encana, were in on the deal and flew in an expert to explain to alarmed local residents at an AEC townhall that they had been the victims of 'eco-terrorists'.

So while Steve distracts us all with his imflamatory remarks about needing “sweeping new powers” to fight Islamists and "the international Jihadist movement" :
“They have declared war on anybody who does not think and act exactly as they wish they would think and act,” Harper said
... environmentalists note that the legislation could be used on them, and the rest of us think that his remarks about Jihadists are a pretty good summation of his apparent declaration of war on the rest of us. Back to G&M :
“These kind of cases involving environmental groups – or anti-petroleum groups as the RCMP likes to frame them – are really the sharp end of the stick in terms of Bill C-51,” said civil liberties lawyer Paul Champ
“I have never seen the RCMP and CSIS have such a cosy relationship with government,” he said. “They’re not supposed to be.”
RCMP spokesman Sergeant Greg Cox insisted the Mounties do not conduct surveillance unless there is suspicion of criminal conduct - having apparently forgotten all about their colour-coded database for people with "notions/expectations regarding the environment."
The RCMP report then wanders bizarrely off into language treating anthropogenic climate change as some kind of hoax perpetrated by enviros. Greenpeace quotes from it :
"NGOs such as Greenpeace, Tides Canada and Sierra Club Canada, to name a few, assert climate change is now the most serious global threat, and that climate change is a direct consequence of elevated anthropogenic greenhouse gas emissions which, they believe, are directly linked to the continued use of fossil fuels….

The use of social media, including the use of live-streaming, provides the anti-petroleum movement the ability to by-pass the traditional news networks, to control and craft its message, and to promote a one-sided version of the actual events, leading to broadly based anti-petroleum opposition.” (emphasis added).
The National Energy Board has sided with Kinder Morgan in refusing the Province of BC's request for more details on how KM would handle an oil spill from KM's proposed $5.4-billionEdmonton-to-BurnabyTrans Mountain pipeline expansion. None of our business apparently. Kinder Morgan cited "commercial, security, and privacy reasons" for their redactions. The NEB is also rather coy when it comes to identifying the former energy industry links among the members that make up their own ranks. NEB bios are full of expressions like "contributed to the creation and development of major energy projects" without getting into exactly which projects and companies they represent. So to augment that lack of info - here's the Nebbies... Not to pick on "Bob" in the toon specifically herebut rather than the NEB stating that Mr. Bob Vergette was once "Vice President, Operations with a major North American liquids pipeline company", it would seem rather more to the point given NEB's current Trans Mountain review to include the info that company he was VP of was Trans Mountain Pipelines - even if it was a decade ago. NEB Chair and CEO Peter Watson - formerly Deputy Minister of the Alberta Executive Council til last June - is at least straight up about NEB priorities. Last November he explained that "the board's main job is to ensure proper construction of the pipeline" while he saw environmental concerns as more "the job of the provinces and pipeline company". NEB Vice Chair Lyne Mercier : 29 years with Gaz Metro. Roland George : according to NEB "worked primarily in the private energy sector for over three decades", is also a Gaz Metro alumni, and held senior positions with the Canadian Energy Research Institute, or CERI, a not-for-profit tarsands booster. Philip Davies : Vice-President, Law and General Counsel of SaskPower ; VP, General Counsel and Corporate Secretary of Encana Gas Storage Shane Parrish : Manager of Business Development for Canadian Petroleum Engineering
Ron Wallace : From NEB : "At AGRA, he was involved in major oil and gas operations throughout the former Soviet Union and Russia where he managed major project assignments in conjunction with the World Bank." Also "senior management positions with Petro-Canada and CanStar Oil Sands Ltd." Kenneth Bateman : "VP of Legal Affairs for Enmax, a large energy distribution, supply and service company" Alison Scott : Deputy Energy Minister of Nova Scotia and offshore oil promoter James Ballem : former Conservative MLA and PEI Minister of Environment and Energy. Mike Richmond : energy lawyer and Co-Chair of the Energy and Power Group at McMillan LLP; and on the board of the Ontario Energy Association. Jacques Gauthier : one time personal envoy to Harper in 2010 for the Vancouver Olympics, served on the Prime Minister's Advisory Committee on the Public Service, and was "senior VP and CEO of Kruger Energy Inc., where he headed up a new division dedicated to the development of renewable energy" . NEB bio : "Mr. Gauthier has contributed to the creation and development of major energy projects in Canada, the United States and Europe." The only NEB member who doesn't seem to fit comfortably into the oil and gas sector insider mold is David Hamilton - Chief Electoral Officer and Deputy Minister and Clerk of the Legislative Assembly of the Northwest Territories. Could be it's possible to be just a bit too much inside : NEB : Onshore Pipeline Regulation Incidents 2000 to 2012 :

"In a precedent setting NEB decision in 2011, the Board granted Kinder Morgan the right to pre-fund future expansion applications from five firm shipping customer contracts to its Westridge terminal. Two of the five companies funding Kinder Morgan’s pre-development costs are Chinese National Oil Companies PetroChina and Nexen, while the remaining three are US Oil, Astra and Cenovus. These companies pay an average premium of $1.45 per barrel to guaranteed $28.6 million per year is allocated to the special account.
Over a ten year period, Kinder Morgan will amass $286 million to push its expansion plans through regulatory review. Pre-funding through shipper charges means that the Canadian public and the Canadian economy bear the risk and the cost of Kinder Morgan’s pre-development process, rather than the risk and cost being borne by Kinder Morgan’s US based shareholders.
Kinder Morgan has confirmed that $136.3 million of its special fund has been allocated to finance the current NEB public review process."
Gosh, was it only five years ago that Alberta Energy spokesman Tim Markle said "Chinese takeover is good news for Alberta", even as Harper was blowing off the Kyoto Accord, supposedly due to China's crappy environmental record, and pledging to build a monument to victims of communism? Beginning Oct 1 for the next 31 years until 2045, under the Canada-China Foreign Investment Promotion and Protection Agreement Harper just ratified on Friday, Chinese corporations will be able to directly sue the Canadian government for any public interest measures that interfere with their ability to make a profit in Canada. Do you think China-owned Nexen, Sinopec, and PetroChina just might consider Enbridge's Northern Gateway Pipeline to be somewhat integral to getting their $30B investment in the tarsands home to China for refining? A month ago, former MP and Liberal leadership contender Martha Hall Findlay had a piece in the G&M : Northern Gateway : You don't build a nation by saying 'No"in which she echoed Tarsands Minister Joe Oliver in invoking pipelines as "nation-building" projects similar to building the "national railway and the St. Lawrence Seaway". Nation-building is apparently no longer about bringing people together in economic resilience but now consists of petrocorps getting their toxic unrefined bitumen to China as quickly and easily as possible. What you may not have known because the G&M failed to mention it is that MHF was writing as a member of an insiders corporate PR group spun off from the Canadian Chamber of Commerce calledPartnership for Resource Trade and its website Power of Canada [powerofcanada.ca]. If you want to hear even more about the Canadian Pacific Railway and the Saint Lawrence Seaway as precursors of nation-building pipelines and how the resource sector is the "front lines of environmentalism" - these are your go-to guys. Power of Canada Advisory Council Members include Perrin Beatty, David Emerson, John Manley, Kevin Lynch, Ted Menzies, MHF of course, and reps from CAPP, TransCanada, Enbridge, Rio Tinto, Teck, Suncor, TransAlta, CD Howe, BMO, Asia-Pacific Foundation, Mining Association of Canada, Port Metro Vancouver,etc. etc. While you're there you can sign up to pledge your support and add your sig to a petition to MPs : "I believe in the Power of Canada". Sample Canada Action supporter comment : "The Northern Gateway pipeline is a nation building project, every bit as important as building the St Lawrence Seaway" Here Canada Action is seen staging, in Cody Battershill aka codyincalgary's words, an "Awesome Pro-Resource, Pro-Pipeline" counter-protest at the "No Enbridge" rally in Vancouver in May - with massive professional-looking banners and a special surprise visit from tarsands advocate Ezra Levant. Wilson and Webster state in their Vancouver Sun op ed : "Are we financially supported by a company, an association or a charitable foundation? No." The first comment under the article is from Cody Battershill aka codyincalgary :

Sigh. We're obviously going to have to massively redefine "grassroots" and "astroturf" before this is over.
This past February, Kathryn Marshall, former spokesy for Ethical Oil, and Brittany Allison, Interim Executive Director of British Columbians For Prosperity, had a "girls night" at a West Vancouver restaurant.

For all their concern about foreign funding, neither Velshi nor Marshall ever answered repeated media questions about whether Enbridge or any other Canadian corporate interest was backing Ethical Oil. Ironically, at the timeEnbridge's chair and 5 out of 12 directors were American. Kathryn's 'girls night' buddy, Brittany Allison, also maintains a focus on shadowy foreign funding from her perch at BC4P moneytrail.ca :
"Wealthy American Foundations pump millions of dollars into campaigns to halt Canadian oil sands production and pipelines."
According to BC4P, that would be the Foundations Rockefeller, Pew, and Tides, among 70 odd others. BC4P Interim Policy Director Brittany Allison was previously :

prior to being Public Affairs Advisor for Fraser Surrey Docks coal expansion project. Like Ethical Oil, BC4P director and frequent CBC commentator Alise Mills also declines to reveal their sources of funding.
"I'm not involved with that group at all. They asked me to be involved but they wouldn't disclose their own funding sources so I wasn't willing to work with them."
Like Ethical Oil before them, BC4P has likely come to the end of its robocalling astroturfing usefulness, only to be replaced by yet another *grassroots org* of undisclosed funding - - like this one :

In the same article, Ward interviews Kenneth Green, the Fraser Institute's Energy and Natural Resources director. Although she doesn't mention it, Green spent 3 years with the Fraser Institute and then seven with the Koch and Exxon-funded American Enterprise Institute before cycling back to the Fraser Institute again last year. In 2007 while with AEI, Green offered $10,000 each to any scientists willing to refute the IPCC's climate change report.
