The human rights fly in the CETA ointment

I'm sure Liberal Senator Joan Fraser was speaking for all of us when she expressed her displeasure at the idea that Europe seeks to link the Canada-EU trade deal to human rights.

Referring to the Strategic Partnership Agreement, CETA's parallel political companion, Senator Rivers explained :
The SPA would enshrine "our common commitment to human rights, to certain common values and to non-proliferation of nuclear weapons," Liberal Senator Joan Fraser said in the Senate on April 18.
However, "the problem is that in the European formula they want to include a clause that would make it possible for the trade agreement to be suspended if the Europeans judge that Canada had engaged in a serious violation of human rights, Ms. Fraser said. "
Canada wants to keep trade and human rights separate ....
The Canadian government has "very properly and entirely appropriately refused" to link the two issues, trying instead to find other ways to "reassure Europeans on human rights," Ms. Fraser said.
Damn straight.
Just tell them none of our other trade agreements are linked to human rights.

China? You're kidding, right?

Colombia? Sure the US State Dept.'s  Colombia 2012 Human Rights Report refers to "the worst human rights record in the hemisphere" including :
"Corruption exacerbated by drug revenue; extrajudicial killings; insubordinate military collaboration with members of illegal armed groups; harassment of human rights groups and activists; trafficking in persons; illegal child labor; political killings; killings of members of the public security forces and local officials; widespread use of land mines and improvised explosive devices (IEDs); kidnappings and forced disappearances; subornation and intimidation of judges, prosecutors, and witnesses; infringement on citizens’ privacy rights; restrictions on freedom of movement; widespread recruitment and use of child soldiers; violence against women, including rape and forced abortions; and killings, harassment, and intimidation of teachers and trade unionists."
But did we let that get in the way of signing off on the Colombia-Canada FTA two years ago, even though Canadian exports to Colombia only amounted to 0.15% ?

The hell we didn't.

After Libs and Cons voted for it 183 to 78 in the House, CIDA backed Canadian extraction industries consultants to rewrite Colombian mining regulations, the Toronto Stock Exchange opened shop, Scotiabank started buying up Colombian banks, and just this January, Foreign Affairs Min  John Baird lifted the ban on Canadian arms manufacturers exporting assault weapons to Colombia, where we're sure they'll be put to continued good use securing the 40% of the country now under consideration for mining contracts by Canadian companies, as whole villages and local mining companies with the bad luck to be sitting on top the gold or oil need to be displaced, even if it means killing off the occasional protesting local priest.

Fun fact : The Canadian embassy in Bogata Colombia resides inside the Scotiabank building.

So, EU, don't be bothering us about linking human rights to trade.
As Senator Joan Fraser points out, in Canada we like to keep 'em separate :
The Canadian government has "very properly and entirely appropriately refused" to link the two issues.

The Combating Terrorism Act vs Justin Trudeau

On Thursday, three days after the Boston Marathon bombings, the Cons still had scheduled an opposition day for Monday - a day on which the opposition parties set the day's agenda. But then on Friday, an hour after learning that Justin Trudeau would spend it introducing his Backbenchers' Spring motion, Government House Leader Peter Van Loan suddenly announced that opp day was cancelled due to the vital national importance of debating the Combating Terrorism Act on Monday instead ... because of the Boston Marathon bombing.
Sure, whatever.

Notable that the S-7 Combating Terrorism Act would have passed already in its previous incarnations as Bill C-17 and C-19 if Steve hadn't prorogued Parliament. On September 22, 2010 the entire Liberal Party but one voted along with the Cons to pass C-17. Then on October 23 2012, the entire Liberal Party save 5 voted in favour of S-7.

Dear Libs : and this is why you can't be taken seriously as a credible opposition to Steve or a partner in any coalition against Steve. Prior to the last election, you expected to be given a pass for voting along with Steve hundreds of times owing to the fact you couldn't afford to bring down the government because you weren't ready to have an election. You don't have that excuse any longer. Really looking forward to hearing your cautious mousy noises against innocent citizens being incarcerated without trial before you all vote along with Steve once again, just so no one can call you soft on terrorism :
Liberal MP Francis Scarpaleggia said that the Liberals will be supporting Bill S-7 and noted that many of the original measures were first introduced by the Chretien government in 2001.

S-7. Let's suppose you know someone, perhaps your landlord or a colleague at work, that the government suspects may one day in the future commit an act of terrorism. You can be detained for up to 3 days without charge while being questioned. You don't get to hear, let alone challenge, any evidence given against you or your colleague, even if it's tortured out of someone you've never heard of in Syria, and you can be held without trial for a year if you don't co-operate.

Sure, you're a model citizen but are you sure you don't know any of these suspected terrorists for instance? ...

Building Resilience Against Terrorism : Canada’s Counter-terrorism Strategy
Public Safety Canada 2012 , introduced by Vic Toews :
"...domestic extremism that is “based on grievances – real or perceived – revolving around the promotion of various causes such as animal rights, white supremacy, environmentalism and anti-capitalism."
which is merely a rehash of the language in :
2010 G8 Summit - Integrated Security Unit Joint Intelligence Group
but minus the reference to "First nations' resource-based grievances" :
1a The Terrorist Threat
     1b The Public Order Threat
"The 2010 G8 summit in Huntsville ... will likely be subject to actions taken by criminal extremists motivated by a variety of radical ideologies. These ideologies may include variants of anarchism, anarcho-syndicalism, nihilism, socialism and/or communism. These ideologies may also include notions of racial supremacy and white power ...
"The important commonality is that these ideologies ... place these individuals and/or organizations at odds with the status quo and the current distribution of power in society.
In addition to these generally held tenets, a variety of grievances exist: These grievances are based upon notions/expectations regarding the environment, animal rights, First nations'(sic) resource-based grievances, gender/racial equality, and distribution of wealth etc."
The G8/G20 - in which thousands of people got locked up for days for no reason whatsoever.

So who wants to see the G8/G20 pilot project experiment in "terrorism" law enforcement expanded into law right across Canada?

The Cons have had this version of the terrorism bill lying around for months, just waiting for a day when they needed to change the channel, and today is that day - they've decided to have the third reading on embedding preventative arrest and secret trials in law for no other reason than to change the channel on Justin Trudeau.
.
10:45 Update :
After watching the proceedings for an hour and a half now, I must apologize for writing re the Libs:
Really looking forward to hearing your cautious mousy noises against innocent citizens being incarcerated without trial before you all vote along with Steve once again, just so no one can call you soft on terrorism.
I take it back - they are not even bothering to do that much.
Aside from the two Lib MPs questioning the timing of bringing this bill forward now to offset Trudeau's backbencher freedom motion, the only debate going on is among NDP MPs regarding provisions of the act. After opening remarks from Con Public Safety parlsec Candice Bergen, the Cons have not responded once.

2pm Update : So "Operation Smooth", carried out by Homeland Security, FBI, and Canadian law enforcement, thwarted the Trainspotter Two without the benefit of the Combating Terrorism Act. Huh.
.
Wednesday April 24 2013 Update : S-7 passes into law.

Libs and Cons - 183 Yes     vs      NDP, Bloc and Green - 93 No

Quagmire update

CBS, Nov 10, 2010, :

"The U.S. military has destroyed hundreds of Afghan civilian homes, farm houses, walls, trees and plowed through fields and buildings using explosives and bulldozers in war-torn Zhari district, a practice that has begun to anger Afghan villagers.

The much anticipated third phase of the Kandahar campaign, called Operation Dragon Strike ...

"You bulldozed some of my trees, they're blocking the canal, now we can’t get water to the orchard," Haji Jilal, a frail, weathered Afghan farmer with a white beard said.

In an effort to clear paths heavily mined by the Taliban, soldiers employed a weapon called a MICLIC, an acronym for Mine Clearing Line Charge. In one thunderous, ground-shaking boom, the weapon clears a path 300 feet long and wide enough for a tank. Breland said his company commander, Cpt. Mike Gold, had used 16 MICLICs in one day. "When Cpt. Gold clears a road he clears a road," he said. "It's clear."

Gold said that in order to clear a safe path for the troops, there was no choice but to destroy Afghan property."

Nearly four years earlier and a few miles to the southwest, the nearly identical tale :

NYTimes, Jan. 13, 2007
"The road that cuts through the heart of Panjwai district here tells all that is going wrong with NATO's war in Afghanistan.
To fight their way into this area and clear it of Taliban insurgents, NATO troops bulldozed through orchards, smashed down walls and even houses, and churned vineyards and melon fields to dust.
Now NATO countries are championing the thoroughfare as a $5 million gift to local people.
“They bombed our orchards and fields and we have nothing now,” said Hajji Abdul Wahab Kutaisi, 65, a farmer from Pashmul. “They made a road through my land.”
Meanwhile Steve chose Remembrance Day to announce from Korea on what we've all been saying for years now : We're staying in Afghanistan till 2014 - in a "training capacity".

NDP Paul Dewar immediately said it would require a vote in parliament but the Libs said they didn't agree.
"That’s a discussion that needs to be had with all the parties after the government tells us exactly what it’s doing. But in principle, I don’t think it’s absolutely necessary,” said Bob Rae, Liberal foreign affairs critic."
Of course not. Because there was never any doubt of it, was there, Bob?

Liberals cave "like spineless jellyfish"

"The Liberals are going to pretend that they're not caving like spineless jellyfish"

was Kady's description of the two Libs on the Ethics Committee, Wayne Easter and Carolyn Bennett, who declined yesterday to vote for an NDP/Bloc motion upholding the supremacy of parliament over the whims and contempt for parliament favoured by the Cons. Instead the Libs opted for a "study" by the Procedures Committee to be tabled some time before March 31, 2011.

Particularly galling is the fact that Easter has led the charge in this committee since May for the right of committees, as the extension of Parliament, to call what witnesses they require for their investigations. But when it came to the actual vote on it, Easter totally caved :
"Do we push this motion through to Parliament and have the Speaker rule, as has happened on the Afghanistan affair?"
No, he explained, because he didn't want to "provoke further animosity" or "inflame this issue."

"I think we here on our side, the Liberals, are willing to try one more time to see if there is good will on the part of the government to make the system work and allow committees to function as they are supposed to be able to."
and then he opted to give them till March of next year to come up with that goodwill.

"What," asked NDP Bill Siksay who tabled the motion, "will happen to all the other committees now?"
Indeed.

The Ethics Committee membership is a Con chair plus 5 Cons, 3 Libs, 2 Bloc, and 1 NDP.
The Proc. Committee has exactly the same balance of membership so it's quite possible come March that we will see a further demonstration of Con/Lib coalition solidarity for contempt of Parliament.
.
The G&M waxes ludicrous on the notion that a motion in the House in support of the supremacy of parliament would immediately lead to an election.

Far better : Eugene Forsey Liberal, Dr. Dawg, Pogge, Jurist, Boris.

Awol Libs defeat war resisters bill

For want of just eight more votes, Bill C-440 - the war resisters bill to give protection to US Iraq war deserters - went down to defeat on Wednesday 136 to 143. The following eighteen Libs expedited that defeat by going awol on the vote :
Michael Ignatieff, Jean-Claude D'Amours, Ruby Dhalla, Kirsty Duncan, Marc Garneau, Albina Guarnieri, Dominic LeBlanc, Keith Martin, John McCallum, Brian Murphy, Anthony Rota, Judy Sgro, Michelle Simson, Frank Valeriote, Joe Volpe, Bryon Wilfert, and Lise Zarac,
with Lib Alan Tonks voting with the Cons against it.

Special mention goes out to Lib Frank Valeriote who was there at 6:25pm for the Criminal Acts Records vote five minutes before the vote on the war resisters bill, and who was on his feet again at 6:42 making a speech in favour of "revitalizing parliamentary proceedings through reforming question period" five minutes after it. Yet somehow Frank went awol in the middle here for conscientious objectors who don't want to fight the US war on terra.

Good job, Frank. You really want to "revitalize parliamentary proceedings"? Try showing the fuck up for what were once called liberal values. It was a Liberal bill.

Also present on Wednesday for the Criminal Acts vote but MIA five minutes later for the war resisters bill were Libs Kirsty Duncan, Brian Murphy, Judy Sgro, Joe Volpe, and Lise Zarac.

L-Girl at We Move to Canada has worked fiercely on behalf of US war resisters. She cites a letter written on Sept. 19 from a former head of the Immigration and Refugee Board to Jason Kenney, Minister of Citizenship and Immigration. In it Peter Shormer criticizes the following July 22 CIC directive concerning war resisters who claim refugee status in Canada :
"Military deserters from other countries have sought refugee protection in Canada. Desertion from the Canadian military is a serious criminal offence.
Therefore these deserters may also be serious criminals and therefore inadmissible to Canada."
What utterly bizarre logic. As per Shormer's letter to Kenney, the CIC directive goes on to specifically target US war resisters for exclusion from Canada by meddling in what should be independent case reviews by the Immigration and Refugee Board.

Luckily for Kenney and the Cons and the US war on terra, this time the Leader of the Opposition and 17 more Liberals had their back.

PSA rocks the Beav

Rocker and blogger Lindsay Stewart, aka Pretty Shaved Ape of the late lamented Canadian Cynic, has joined the rest of us ink stained wretches at The Galloping Beaver. One of my all time favourite bloggers, PSA's first post at The Beav takes firm aim at the footling Libs and their cold feet of clay.

Take it away, PSA ...

Libs pass the Cons budget, again

On Tuesday the following 30 Liberals passed the Cons budget bill by not showing up for the vote :

Larry Bagnell, Carolyn Bennett, Gerry Byrne, Denis Coderre, Irwin Cotler, Jean-Claude D'Amours, Ruby Dhalla, Stéphane Dion, Ujjal Dosanjh, Ken Dryden, Martha Hall Findlay, Hedy Fry, Albina Guarnieri, Andrew Kania, Jim Karygiannis, Derek Lee, Gurbax Malhi, Keith Martin, John McKay, Dan McTeague, Bernard Patry, Glen Pearson, Bob Rae, Pablo Rodriguez, Todd Russell, Michael Savage, Alan Tonks, Bryon Wilfert, Borys Wrzesnewskyj and Peter Milliken

Click on the name to see their full voting record.

Ignatieff termed the budget a "dumpster bill" and "an abuse of power" for, among other omnibus outrages, its provision to give the environment minister the power to bypass environmental assessments on major projects he wants passed. Then the Libs passed the dumpster bill, as they have every Con budget since Harper came to power 2008. (Thanks for the correction, Jurist)

Blue Dog Liberals : Banner day, assholes

1) You voted against stopping a $¼-million government subsidy to an asbestos lobby group.

2) You dogwhistled about abortion in your maternal health initiative for developing countries "wedge" motion but were too afraid to actually include the word.

3) You used the "wedge" motion - intended to smoke out the Cons - to give your own party a very public wedgie, losing the final vote : 144-138.

Bonus : 4) You voted for the Harper budget supplementary estimates by mistake, necessitating a redo.

A special shout out to the following Blue Dog Libs for voting against the maternal health motion : John McKay, Paul Szabo, and Dan McTeague, and to Albina Guarnieri and Gurbax Malhi who abstained.

Libs missing in action for the vote : Derek Lee, Anita Neville, Gerard Kennedy, Andrew Kania, Borys Wrzesnewskyj, Alan Tonks, Marlene Jennings, Joe Volpe, Lawrence MacAuley, Stephane Dion, Mario Silva and Jim Karygiannis.

*Blue Dog Democrats in the US oppose abortion, SSM, and gun control.

Security theatre of the absurd

Given that the Cons blocked the Military Police Complaints Commission from receiving documents on the Afghan detainees :
"Canada's former top military police officer, retired navy captain Steve Moore, advised he had documents that he wanted to turn over to the inquiry, however Mr. Moore and his lawyer had to sign a pledge preventing them from passing the documents to the inquiry."
and redacted the docs they did allow :

"This is what the Bravo Company, 2nd Battalion Princess Patricia’s Canadian Light Infantry Battle Group sergeant wrote in June 2006 about the Afghan detainee who was beaten up:

"We then photographed the individual prior to handing him over, to ensure that if the ANP did assault him, as has happened in the past, we would have a visual record of his condition."

but this is what the government sent to the Military Police Complaints Commission:

"We then photographed the individual prior to handing him over (redacted)."
and also sandbagged the Parliamentary Afghan committee by threatening and muzzling witnesses:
"The federal government is blocking diplomat Richard Colvin from giving documents to a special House of Commons committee investigating Afghan torture.
Justice Department lawyers have told Colvin - through the Foreign Affairs department - that they do not accept the view that testimony before Parliament is exempt from national security provisions of the Canada Evidence Act.
Violating Section 38 of the Canada Evidence Act can be punishable by five years in prison."
before finally shutting parliament down altogether to shut everyone up about it ....

who could possibly pretend to believe they will now freely hand over those very same docs to retired Justice Iacobucci?

Answer : The Libs.

The Cons new tough-on-window-dressing-crime bill

Bill C-15, an amendment to the Controlled Drugs [and Uncontrolled Growth of the Prison Industry] Act, guarantees, among other travesties, automatic jail time for people who grow and sell five marijuana plants.
Believe it or not, this is an improvement over what the Cons originally proposed - jail time for just one plant -until the Bloc and NDP managed to leverage it up to five plants in the Committee on Justice and Human Rights, where 13 0f the 16 expert witnesses called spoke against the new bill.

There's a lot of old US War on Drugs bullshit here, endorsed by the Libs and Cons just as the US begins to repudiate it.

From today's Hansard, HoC :

"California, New York, Michigan, Delaware, Massachusetts are all repealing their mandatory minimum sentences with other states considering the same.

Counsel to the United States House of Representatives committee on the judiciary, Eric Sterling, stated emphatically his decision to promote mandatory minimum sentences in the United States was probably "the greatest mistake of my entire career over 30 years in the practice of law".

What the Americans found was that the goal of the legislation to reduce drug use failed. The goal of safety in the communities failed. The goal of raising the prices of drugs and lowering the purity failed. The goal of reducing organized crime failed."

Yesterday in the HoC, Keith Martin, Lib, asked why we can't "decriminalize simple possession, for example, of marijuana and allow people to have a couple of plants"?

Indeed. People receiving sentences of two years less a day will wind up in the already overcrowded provincial prisons. What to do? What to do?

The Canadian Bar Association, as quoted in the HoC :

"We believe the Bill would not be effective, would be very costly, would add to strains on the administration of justice, could create unjust and disproportionate sentences and ultimately would not achieve its intended goal of greater public safety."
Libs will have to suck it up hard to vote for this one on Monday, as they party with the Cons like it's 1969. The NDP and Bloc will vote against it.

Scott has a round-up of the Liberal blogger revolt against it; Jennifer at Runesmith is organizing an email campaign. Go, you Liberal bloggers!

Iggy prepares to "swallow hard"

Congratulations, Libs. Tomorrow will mark the 45th time in a row that you have sat on your hands in Parliament because you can't afford to fight an election because no one gives money to fight elections to parties that sit on their hands in Parliament.

Iggy - PM if necessary but not necessarily PM - did go all medieval schoolmarmy on they Con ass, demanding regular quarterly progress reports on how the budget plan he had just finished lambasting was progressing.

G&M :
"We're putting this government on probation," Mr. Ignatieff said.
By 4 p.m., the government, relieved that the conditions did not require more substantive concessions, accepted the amendment, saying that providing updates to Parliament and facing votes wasn't really a new burden.
"This is nothing new. … We always report back to Parliament," Government House Leader Jay Hill said.
"The amendment just states the obvious, so we're very pleased to comply with it as we move forward."

Shorter Jay Hill : Swallow harder, bitch.
